A Special Payment Arrangement can help you avoid a council tax wage arrestment.

By agreeing affordable instalments with your council before enforcement, you can often stop an arrestment being used. Where one is already in place, the council may agree to recall it, though, unlike a Debt Arrangement Scheme or trust deed, that is at the council’s discretion.

What is a Special Payment Arrangement?

A Special Payment Arrangement is an agreement with your local council to repay your outstanding council tax in affordable instalments over a period that works for you, rather than in a single lump sum. It is arranged directly with the council and the sheriff officers acting on their behalf. It is not a formal or statutory scheme, so it does not appear on any insolvency register.

Will a Special Payment Arrangement stop a wage arrestment?

A Special Payment Arrangement is most effective at avoiding a wage arrestment. If you make an offer before the council uses enforcement, an arrangement can stop an arrestment being used at all. Where an arrestment is already in place, the council can agree to recall it once an affordable arrangement is set up, but this is at their discretion rather than automatic.

Timing matters

The best time to arrange a Special Payment Arrangement is as early as possible, ideally before the council instructs sheriff officers or uses a wage arrestment. Acting early gives you the widest choice of options and the best chance of keeping the situation informal and manageable. Even if enforcement has already begun, it is still worth getting in touch, as there may be steps that can help.

What happens if it is not accepted, or if I fall behind?

If the council does not accept a proposed arrangement, or if you fall behind on one that has been agreed, they can proceed to enforcement such as a wage arrestment. It is unlikely that a further arrangement will be agreed after a default, so any offer needs to be realistic and something you can genuinely keep up. This is where getting the offer right first time matters, and where our experience can help.

Do I still pay ongoing council tax, and will it affect my credit?

Yes, you will still need to keep paying your current, ongoing council tax as normal, on top of the instalments towards your arrears. Because a Special Payment Arrangement is an informal arrangement to pay rather than a formal solution, it is not recorded on an insolvency register and does not carry the same credit-file impact as a Debt Arrangement Scheme or trust deed.
