On the council tax route, a bill, a reminder notice and a final notice. On the ordinary decree route, the agreement or account, the decree and a charge for payment, and on both routes a debt advice and information package before the arrestment can take effect.

Which documents belong to a wage arrestment, and what does each one do?

Nine, and not all of them exist on both routes. Which set you should be holding depends on whether the debt is council tax collected under a summary warrant or an ordinary debt with a court decree.

The route column is the one that decides what should exist. Whether you can get a wage arrestment without going to court sets out how the two chains differ.

A charge for payment belongs to the decree route only, and a council tax reminder notice belongs to the council tax one.

The document that is a statutory condition

One item on that list is not just paperwork. Section 47(3) of the Debtors (Scotland) Act 1987 provides that an earnings arrestment does not take effect unless the creditor gave you a debt advice and information package no earlier than 12 weeks before service.

That makes its date worth pinning down before anything else. What warning you get before a wage arrestment covers the window in full.

Which of them go to you and which go to your employer?

Everything in that table goes to you apart from the earnings arrestment schedule, which is served on your employer under section 47(2). Service on the employer is what puts the arrestment into effect.

Why the split is the whole problem

A stale address stops the warnings reaching you while leaving the enforcement chain intact. Payroll still gets the one document that matters.

That is the structural reason a deduction can appear with nothing on your doormat. It is also why the first thing to fix is the address the council or creditor holds for you.

What your employer holds that you do not

Payroll holds the schedule and the date it arrived. What an earnings arrestment schedule is sets out what the document instructs them to do.

Ask payroll in writing to confirm the date they received it and the first pay date it will be applied to.

The start date for the money is not fixed by the paperwork at all. Section 47(1) sets the duty by pay day, so the first affected pay date is a question for payroll.

How can you tell what a document is without knowing what it should say?

By its date, its sender and the step it belongs to. Those three things place any letter in the chain, and none of them depends on the wording.

Why this page does not quote wording

Wording varies and function does not. A page that told you what a notice says would have you checking your own paperwork against something invented.

The recovery sequence itself sits in the Council Tax (Administration and Enforcement) (Scotland) Regulations 1992, and the diligence provisions sit in Part III of the 1987 Act.

Three questions that place any letter

  • What date is on it, and when did it actually arrive?
  • Who sent it, the council, another creditor or a sheriff officer firm?
  • Which step does it belong to, a reminder, a final notice, a charge or an arrestment?

Write the answers on the front of each item in pencil as you file it. It takes a few minutes and it turns a pile into a sequence.

Answer those and you know how far along the account is. When a wage arrestment starts after the paperwork arrives turns that into a date.

What if some of the documents never arrived?

Raise it in writing straight away and ask for copies. A missing notice does not automatically make an arrestment invalid, and it is still worth having on the record.

Validity is one question

Section 50(1) allows an application for a declarator that an arrestment is invalid or has ceased to have effect, and section 50(3) covers a determination of a dispute about how it is operating. Challenging a wage arrestment you think is wrong sets out both routes.

There is no time limit on either and no hardship ground on either. Take the dates to a money adviser or to the sheriff clerk before lodging anything.

Affordability is a different question

A sheriff cannot reduce a Schedule 2 deduction because you cannot afford it. Where the problem is that the deduction leaves you short, which debt solution is best if you have a wage arrestment compares the routes that displace the diligence instead.

How do you ask for copies of the ones you do not have?

In writing, quoting the reference from any letter you do hold, and to the body that issued the document rather than to whoever wrote last. Put the request in writing even if you phone first.

The three requests worth making

Where a complaint goes if you get nowhere

Complaints about a sheriff officer firm’s conduct go to the firm first, then to the Society of Messengers-at-Arms and Sheriff Officers, then to the sheriff principal. Keep a copy of each stage.

What is worth checking on the documents you do have?

Six things, and every one of them is a fact rather than a matter of interpretation. Each has somebody who can confirm it in writing.

Two things worth raising in the same letter

Payments are normally allocated to the oldest year of arrears first unless you say otherwise, so state in writing which year a payment is for. How to set up a council tax payment arrangement covers putting an offer.

It is also worth asking whether a discount, exemption or Council Tax Reduction was ever applied to any of the years in the balance, because the single person discount is 25% and a reduction can cover the whole bill.

Which documents matter after the deductions start?

Your payslips and a written breakdown of the balance. Between them they show what has been taken and what it has been taken against.

The payslip becomes the record

Save every payslip from the first affected pay date onwards, because a section 50(3) application turns on what has actually been taken. How you know if you have a wage arrestment covers what to look for on it.

The employer may also take £1.00 per deduction as an administration charge, on top of the arrested amount. That is separate from the sum the statutory table produces.

The balance keeps moving

Sheriff officer fees are set by an Act of Sederunt and added to what you owe, and what fees sheriff officers can charge covers how they are set.

How long should you keep the wage arrestment documents?

Until the debt is cleared, and for a good while after that. Council tax arrears do not fall away on the same timescale as an ordinary consumer debt.

Why council tax paperwork keeps its value

Council tax is excluded from the five-year short negative prescription, and a summary warrant carries no expiry. How far back a council can chase council tax arrears sets out what that means.

How to keep the file

Put everything in date order, keep the envelopes and note the date each item arrived. A tidy file turns a vague complaint into a specific one.

Scan or photograph each item as it comes in and keep the copies somewhere other than the house. A file that survives a house move is worth the ten minutes it takes.
