Letters from a council or a firm of sheriff officers use words like warrant, diligence and enforcement, and they read like something out of a courtroom drama. They are not.

The council wants the money, and the law gives it ways to collect the money. Punishing you is not part of the process, and what happens if you do not pay your council tax sets out the recovery route from start to finish.

Below is what separates a civil debt from a criminal matter, what that means for your criminal record and your credit file, and what a Scottish council can do instead.

What makes council tax a civil debt rather than a criminal matter?

A civil debt is money one party owes another, recovered through civil procedure. The council is acting as a creditor chasing a sum, not as a prosecutor bringing a charge.

Council tax sits under Part 2 of the Local Government Finance Act 1992, and collection is handled under the Council Tax (Administration and Enforcement) (Scotland) Regulations 1992.

Those regulations set out reminders, final notices and the summary warrant procedure. None of them creates a criminal offence for leaving the bill unpaid.

How a criminal matter and a civil debt differ

The two systems never meet on a council tax bill. The table below sets out what each one involves.

Everything in the right-hand column is a civil process. There is no charge, no plea and no verdict anywhere in it.

Nobody is deciding whether you are guilty

When a council applies for a summary warrant, the sheriff court grants it on the strength of a certificate from the council. There is no hearing and you do not attend.

That can feel unfair, because you never get the chance to argue at that point. It also tells you something reassuring, which is that the court is not being asked to judge your conduct.

Will council tax arrears give you a criminal record?

No. Council tax arrears in Scotland produce no conviction and no caution, so there is nothing to declare on a disclosure check.

Disclosure checks, visas and professional registration

This matters for people working in care, education, healthcare, security and the public sector, where disclosure checks are routine. A council tax debt is not a criminal matter, so it does not appear on one.

The same goes for visa applications and professional registration forms that ask about convictions. There is no conviction to disclose.

What about letters that mention the sheriff court?

Recovery letters may reference the sheriff court, because that is where the warrant is granted. That reference is administrative, and it does not mean criminal proceedings have started.

If a letter reads as though you are being prosecuted, take it to a money adviser and ask them to go through it with you.

Do council tax arrears show up on your credit file?

No. Council tax is not reported to credit reference agencies, and a summary warrant is not a court decree obtained after a hearing.

England and Wales runs a different recovery system, and content describing it travels north. The position in Scotland is that neither the arrears nor the warrant creates a credit file entry.

Why a summary warrant is not a decree

A decree follows a court action, in which a creditor sues and you have the chance to defend. A summary warrant follows an administrative application, with no hearing and no defence.

That difference is why the two are treated differently. One is a judicial finding after a process you could take part in, and the other is a collection document.

What is recorded, and what is not

The six-year entries in that table are the ordinary consumer debt position, not the council tax one. If you also owe on credit cards, loans or catalogue accounts, that is where a court decree against you would be recorded.

So the two questions need separate answers. Council tax arrears leave no trace on a credit report, while an ordinary debt taken to court does.

What people actually notice

The visible effect of council tax enforcement is a deduction on a payslip rather than anything on a credit report. Payroll operates it, and only payroll and whoever handles the paperwork need to know.

What can a Scottish council actually do instead?

It can apply for a summary warrant, which adds a 10% statutory surcharge to the outstanding council tax, and then instruct sheriff officers to carry out diligence.

The route there is a sequence of letters rather than one decision. A missed instalment brings a reminder notice, typically about two weeks later, with usually 7 days to put it right.

A council may issue up to two reminders in a financial year. On a further default a final notice follows, usually with 7 days, and after that the right to pay by instalments is lost and the whole remaining year’s balance becomes due.

Day counts vary a little by council policy, so work from the dates printed on your own letters.

The enforcement options in full

None of these is a punishment. Each is a way of collecting a sum that is legally due.

Deductions from wages come off net pay under Schedule 2 to the Debtors (Scotland) Act 1987, on tables in force since 6 April 2025.

Council tax is one of the debts that can reach your wages, and because the council holds a summary warrant no charge for payment has to be served before an earnings arrestment starts.

What sheriff officers can and cannot do

Sheriff officers are officers of the court, appointed by and accountable to the sheriff, and they are not bailiffs. The council instructs a sheriff officer firm, and the firms working for Scottish councils include Scott & Co, Stirling Park, Walker Love and Alex M Adamson.

For ordinary council tax arrears they cannot force entry to your home. Forced entry is only available under an exceptional attachment order, which needs a sheriff to be satisfied that exceptional circumstances exist and is rare.

They are regulated under the Act of Sederunt (Messengers-at-Arms and Sheriff Officers Rules) 1991, and the Society of Messengers-at-Arms and Sheriff Officers maintains a code of practice. Their fees are set by the court and added to what you owe.

Why is the answer different in England and Wales?

England and Wales has a committal power that can lead to imprisonment for council tax non-payment. That power does not exist in Scots law.

Different officers, different powers

Enforcement south of the border is carried out by bailiffs and High Court Enforcement Officers, working under different legislation. Scotland uses the summary warrant, and sheriff officers carry out diligence.

If you have read about someone being jailed over council tax, check which legal system the story describes. Scots law has no committal power for council tax.

Do not apply English advice to a Scottish debt

Debt advice written for an English audience describes a different system of recovery. If a page mentions bailiffs, liability orders or the threat of prison for council tax, it is not describing your situation.

Check that any guidance you read names Scottish law. The words to look for are the sheriff court, the summary warrant, sheriff officers and diligence, and Scotland’s courts service will confirm which court covers your area.

What should you do if you cannot pay your council tax?

Contact the council’s recovery or money advice team, ask what arrangement they will accept, and check at the same time whether you qualify for Council Tax Reduction or a discount.

Ask for an arrangement before enforcement starts

Ask the council what it will accept before enforcement starts. One route is a special payment arrangement covering the arrears, and there is no statutory maximum period for spreading them.

Councils commonly work to the current financial year but will consider longer where you can evidence what you can afford. Ask for whatever is agreed to be confirmed in writing.

Payments are normally allocated to the oldest year of arrears first unless you say otherwise. Our council tax debt advice page covers what to ask a recovery team for.

Check what you are entitled to first

Council Tax Reduction can cover up to 100% of your liability, and single person discount is 25% where only one adult lives in the property. There are further discounts and disregards for full-time students, apprentices, care leavers under 26 and live-in carers.

A disabled band reduction charges the bill one band lower where a disabled resident needs an extra room, another bathroom or kitchen, or space to use a wheelchair indoors. Check who is actually liable as well, because joint and several liability catches out separated couples and former flatmates.

If the arrears are more than you can clear

The Debt Arrangement Scheme is a statutory scheme run by the Accountant in Bankruptcy, letting you repay in full over an agreed period with interest, fees and charges frozen.

Once a Debt Payment Programme is approved, an existing earnings arrestment stops and creditors cannot start new diligence. Council tax arrears can go into a programme, though your current-year liability cannot and has to be paid alongside.

A Time to Pay Order is competent against a summary warrant, and where the sheriff grants one the sheriff must recall any existing earnings arrestment. The debt outstanding has to be £25,000 or less excluding interest.

A Time to Pay Direction is a different route and is not available against summary warrant debt, because a direction responds to a court action. It is also not settled whether an earnings arrestment alone satisfies the conditions, so a money adviser or the sheriff clerk should confirm competency on your facts.

A statutory moratorium gives six months of protection and you get one per rolling 12 months. It stops service of a charge for payment, stops new diligence and stops creditor petitions for sequestration.

It does not stop a creditor obtaining a decree, and interest and charges keep accruing throughout.

Whether a creditor can carry on an earnings arrestment your employer is already operating is treated differently in the Accountant in Bankruptcy’s adviser guidance from the general statement of the rule. Ask a money adviser to confirm the position on your facts before relying on it.

A protected trust deed ends an earnings arrestment on the date of protection under s.173 of the Bankruptcy (Scotland) Act 2016, not on signing. Money already deducted before that date is credited against the debt rather than refunded.
