Instalments, and one option Fife has that most councils do not

Fife’s payment page says council tax can be paid in typically 10 or 12 monthly payments spread from April to March. Direct Debit payers can pay weekly, every two weeks, or monthly on the 1st or the 15th.

The weekly and fortnightly option is genuinely unusual among Scottish councils. If you are paid weekly and your wages are already being arrested, it lets the council tax come out in step with your pay cycle rather than in one lump.

How do you ask Fife Council for a payment arrangement?

Set out what you can afford, backed by a simple budget, and ask for the arrangement in writing. Phone the council tax service on 03451 55 11 55, option 2, and confirm afterwards in writing what was agreed.

  • Your council tax reference number and the address the arrears relate to.
  • What changed and when: reduced hours, redundancy, illness, a relationship ending.
  • Your income after tax and your essential outgoings.

Two things people miss

There is no statutory rule setting the order. The Council Tax (Administration and Enforcement) (Scotland) Regulations 1992 say nothing about how a payment is applied between years, so it is council policy rather than law.

So put the year in writing if you want money to go against the current bill. Otherwise the current year can quietly slide into recovery while you believe you are paying it.

There is also no statutory maximum period for spreading council tax arrears. Councils commonly work to the current financial year and will consider longer where affordability is evidenced, so it is reasonable to ask.

What should you have ready before you get in touch?

Your reference number, a simple income and expenditure list, and the dates of any letters you have received. Ten minutes of preparation usually turns a difficult call into a short one.

A short checklist

  • Your council tax bill or the most recent recovery letter.
  • Payslips or benefit award letters covering your current income.
  • Your rent or mortgage, energy, water, food, travel and childcare costs.
  • Details of any other priority debts you are paying.

  • A 25% single person discount where you are the only adult in the property.
  • Disregards for full-time students, apprentices, care leavers under 26, live-in carers and people who are severely mentally impaired.
  • The disabled band reduction where a disabled resident needs extra space.

What happens if you do not contact the council?

The statutory recovery sequence runs on without you: a reminder, then a final notice, then the loss of the right to pay by instalments, then a summary warrant with a 10% statutory addition on the outstanding balance.

That sequence comes from the Council Tax (Administration and Enforcement) (Scotland) Regulations 1992 and applies across Scotland. Fife’s own arrears page does not publish reminder or final notice periods, so treat the day counts as typical rather than as Fife’s stated practice.

Once a summary warrant is granted

It is granted by the sheriff court on the council’s application and certificate under Schedule 8 to the Local Government Finance Act 1992. There is no hearing, you do not attend, and you cannot contest liability at that point, as what a summary warrant is explains.

The council can then instruct sheriff officers, and Schedule 8 authorises an earnings arrestment on the warrant itself. Whether a charge for payment must also be served first is not settled, so ask a money adviser or the sheriff clerk what applies on your own account.

Two reassurances worth stating plainly

A summary warrant does not appear on your credit file, because councils do not report council tax to credit reference agencies. Non-payment of council tax cannot lead to imprisonment in Scotland.

Which sheriff officers does Fife Council use?

Two firms is normal, not a warning sign

Which firm holds the account changes nothing about what can be done. Sheriff officers are officers of the court, appointed by and accountable to the sheriff, and their powers come from statute rather than from the firm.

The limits on what they can do

  • They cannot force entry to your home for ordinary council tax arrears.
  • Forced entry is available only under an exceptional attachment order, which needs the sheriff to be satisfied there are exceptional circumstances, and is rare.
  • Money in the home cannot be attached at all, apart from a narrow exception for antique or collector’s coins.

What can you do if a wage arrestment has already started?

Get free money advice quickly, because the routes that stop an earnings arrestment are formal ones. There is no hardship application against an ordinary earnings arrestment, so the answer is a change of route rather than an appeal.

What the deduction is

It is fixed by Schedule 2 to the Debtors (Scotland) Act 1987 and taken from net pay, on tables in force since 6 April 2025. Monthly net pay of £1,800.00 produces £172.50, while £750.00 or less produces nil.

The routes that do stop one

An approved Debt Payment Programme under the Debt Arrangement Scheme stops an existing arrestment, and whether council tax arrears can go into a Debt Arrangement Scheme covers what can be included.

Sequestration, Minimal Asset Process bankruptcy and a protected trust deed all stop one by statute. For a trust deed the trigger is the date of protection rather than the date you sign.

A time to pay order is competent against a summary warrant debt where the debt outstanding is £25,000 or less excluding interest. Where the sheriff grants one, the sheriff must recall any existing earnings arrestment.

Fife Council runs a Community Support Helpline on 0800 952 0330, and Citizens Advice and Rights Fife has a dedicated debt line on 0345 140 0094. Both are free and both are open on weekdays.

The council’s own service

The helpline is open 9am to 5pm Monday to Friday and covers benefits, debt and making money go further, with drop-in and appointment sessions in Cowdenbeath, Dunfermline, Glenrothes, Kirkcaldy, Levenmouth, North East Fife and South West Fife. The page was last updated on 14 August 2026.

CARF runs separate lines for different needs, all open 10am to 3pm. The debt line is 0345 140 0094, general advice is 0345 140 0095 and welfare benefits is 0345 140 0092, on its own contact page.

The council writes the same debt number as 03451 40 00 94. They are the same number, so do not spend time deciding between them.
